New York CONFISCATES Legally Owned Firearms from Law Abiding Citizen Under New Gun Control "SAFE" Law

OMG! Watching Fox News right now. Megyn Kelly just covered a story about how New York recently CONFISCATED someone's 7 legally owned firearms. Oh, guess what - they got the WRONG GUY! The person received a letter from the county threatening that if he didn't turn in his guns they would come and get them. Being law abiding, he did it. But they MISIDENTIFIED him and have now admitted so.

This happened in Erie County and is a direct effect of New York's recently passed gun control laws. The Fox video segment covers the details of how it happened and why it's connected to the new legislation. The county clerk's statement is that Governor Andrew Cuomo needs to take a step back and realize they got this law wrong and that as long as they don't FIX the system first, problems like this will continue to happen.
NR: We are on the road to despotism, sir. It is incredible to me how many of our countrymen apparently do not have the intelligence, or the education to recognize this. How many times in history have people gleefully backed a despotic government, that incrementally removed their rights, and increased its authority? By the time the unthinking masses realize what they have done, it will be too late.
  • MH: Not likely the first person in the United States to be wrongly accused of something by law inforcement. Or the last.


  • ME: There's no doubt that's true, MH. The thing that makes this one so unpalatable is that it was predictable and avoidable. The problems in our NICS background check system need to be fixed before its use is expanded. The problems have been known for more than 10 years and this is exactly what the NRA and other organizations were warning of. In this case, the time between new law and directly related problems is being measured in days. In a previous case, problems with the same New York legislation were measured in hours - when the legislature rushed to a vote without full consideration of the language of the bill and didn't even provide an exemption for law enforcement officers to carry more than 7 rounds in their firearms magazines, or consider the fact that 7-round magazines don't even exist for the millions of firearms already legally owned in New York.

    It seems the specific 'accusation' here was that someone reported someone with a similar name for potentially being a danger to themselves or others due to psychological counseling. While this is the kind of behavior that needs to happen, it needs to be correct and it needs to come from qualified people using objective criteria. The current New York law allows it to come from qualified psyc personnel but also from nurses and clerks. That's not good. There was also no due process and a constitutional right delayed, or in this case removed, is a right denied.

    The people screaming for more gun control and "universal background checks" should be focused on fixing problems first and then expanding use - just like a business will pilot a new product or business process before global expansion. The pilot has been running for decades and it's results are not good. The reasons are known. Fix the root causes of those points of failure. Then we can have the reasonable discussion about expanding it.

Here's the latest information on this incident. Lawsuit is coming. Let's hope this law abiding citizen gets rich of Governor Cuomo and the gun-hating politicians of New York.
